Effective date: [TBD] · Last updated: October 29, 2026 (draft 1)
DRAFT. Not legal advice, and not yet in effect.
These Terms govern your use of rightballot.com and Right Ballot polls, operated by Right Ballot LLC (“Right Ballot”). By using the site or voting in a poll, you agree to these Terms and our Privacy Policy.
1. Who can vote
You must be at least 18 years old and a resident of the United States. You agree to give truthful answers and to use your own email address.
2. One ballot per person
Each person may vote once per poll. You may not use bots, scripts, multiple email addresses or other methods to vote more than once or to manipulate results. We may remove ballots we believe are fraudulent and block access to anyone who abuses the site.
3. About our polls
Right Ballot polls are unscientific, opt-in surveys of self-selected readers. Results are not weighted to match the population, are not a projection of any election outcome, and are provided for information and entertainment. We may publish, quote and comment on aggregated results in any medium.
4. Email and your information
When you vote, you agree to receive email from Right Ballot as described in the consent you gave on the poll page, and you can unsubscribe at any time. How we use and share information is described in our Privacy Policy.
5. Prizes and giveaways
No purchase or vote is necessary to enter any Right Ballot giveaway. Any prize promotion will be governed by separate official rules posted with that promotion. [COUNSEL: Substack currently promises “the opportunity to win prizes.” Official Rules required before any prize is offered.]
6. Our content
The site, logo, name “Right Ballot,” poll questions and results are owned by Right Ballot LLC. You may share links to our polls and results and quote results with attribution to Right Ballot.
7. No warranties; limitation of liability
The site is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Right Ballot is not liable for any indirect, incidental or consequential damages arising from your use of the site, and our total liability for any claim is limited to $100.
8. Governing law
These Terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in San Diego County, California. [COUNSEL: arbitration / class-action waiver?]
9. Changes
We may update these Terms by posting a new version on this page.
