Draft for attorney review · Brigitte Taylor
Privacy Policy
Effective date: [TBD — on attorney approval] · Last updated: October 29, 2026 (draft 1)
DRAFT. Not legal advice, and not yet in effect. Yellow-highlighted items are open questions for counsel.
This Privacy Policy explains how Right Ballot LLC (“Right Ballot,” “we,” “us”) collects, uses and shares information when you visit rightballot.com, take a Right Ballot poll, or read our newsletter. Right Ballot LLC is a California limited liability company with a mailing address at 6965 El Camino Real, Ste 105 #613, Carlsbad, CA 92009.
1. Information we collect
Information you give us. When you take a poll we collect your email address; your poll answers; and, the first time you vote, your first name (optional), ZIP code, age range, gender, party registration and political ideology. You may choose “Prefer not to say” for any demographic question.
Information collected automatically. Your IP address (we store only a one-way hashed version, used to prevent fraud and duplicate voting), approximate location derived from your IP address (country and state/region), browser and device information, the date and time of your visit, and referral or campaign information in the link you clicked (for example, which email brought you here).
Cookies. We set one first-party cookie, rb_vid, that remembers you on this browser for up to 400 days so you do not have to re-enter your email and demographic answers on future polls. It contains a random identifier and a security signature, not your email. You can clear it at any time with the “Not you?” link on any poll or by deleting cookies in your browser. Cloudflare Turnstile, which we use to block bots, may process device and browser signals to tell humans from automated traffic. Our pages load fonts from Google Fonts, which receives your IP address.
Personalized email links. Links in our emails may contain a coded token that identifies your email address, so the poll can recognize you on any device without asking you to retype your information. If you forward one of our emails, the recipient could vote as you; please use the “Not you?” link if a poll shows the wrong email address.
Information from others. If you received our email because you are on a list provided by a list owner or broker, we receive your email address (and possibly name and postal information) from that source. If you subscribe to our newsletter, Substack shares your subscription information with us.
[COUNSEL: Poll answers and party/ideology reveal political opinions. Confirm treatment under CCPA/CPRA (“philosophical beliefs”) and other state privacy laws, and whether any “sensitive data” consent or “limit the use” notice is required.]
2. How we use information
- To run polls, count one ballot per person, and show and publish aggregated results.
- To remember you so future polls are faster (we ask demographic questions only once).
- To send you poll results, newsletters, news and offers from Right Ballot, if you agreed.
- To share or rent your contact information to like-minded organizations as described below, if you agreed.
- To analyze results by group (for example, by state, age range or party).
- To prevent fraud, abuse and automated voting, and to comply with law.
3. How we share information
Published results. We publish poll results only in aggregate. We do not publish your name, email or individual answers.
Service providers. Companies that host and operate our site and email on our behalf, such as Cloudflare (hosting, database and bot protection), Substack (newsletter) and our email delivery provider. [List ESP once chosen.]
Like-minded organizations. If you agreed when you voted, we may share, rent or exchange your contact information [and the profile details you provided — DECISION for Matt/counsel: which fields are included in list rentals, and whether poll answers are ever included] with conservative and right-of-center organizations, candidates, campaigns, publications and causes, including through list brokers and list managers. These organizations may contact you with their own messages, and their use of your information is governed by their privacy policies. Under California and some other state laws, this may be a “sale” or “sharing” of personal information, which you can opt out of at any time (see Section 5).
Legal and safety. When required by law, to protect our rights or users, or in connection with a merger, sale or transfer of our business.
We do not share newsletter-only (Substack) subscribers’ information with outside organizations. [Confirm with counsel; current internal rule: Substack subscribers are not rentable until reviewed.]
4. How long we keep information
We keep your profile and poll answers for as long as you remain on our list or until you ask us to delete them, and we keep aggregated results indefinitely. Hashed IP addresses and technical logs are kept [e.g., 24 months].
5. Your choices and rights
- Unsubscribe from any email with the link at the bottom of the message.
- Do Not Sell or Share. Opt out of the sale or sharing of your personal information at rightballot.com/do-not-sell or by emailing us. We also treat a browser’s Global Privacy Control (GPC) signal as a valid opt-out.
- Access, correction and deletion. Depending on where you live (including California, Virginia, Colorado, Connecticut, Texas and other states with consumer privacy laws), you may have the right to know what personal information we have about you, to correct it, to delete it, and to appeal our decision. Submit a request at rightballot.com/do-not-sell or by email. We will verify your request by confirming control of your email address. You may use an authorized agent.
- We will not discriminate against you for exercising these rights.
[COUNSEL: Confirm which state laws apply. Because revenue may come mainly from list rental, the CCPA’s “50% or more of annual revenue from selling or sharing” threshold could apply regardless of company size. If any prize, sweepstakes or giveaway is offered for voting or subscribing (the current Substack header mentions “the opportunity to win prizes”), a CCPA Notice of Financial Incentive and Official Rules are likely needed.]
